A regular meeting of the Board of Trustees of the Charter Township of Canton was held Tuesday, June 26, 2018 at 1150 Canton
Center S., Canton, Michigan. Supervisor Williams called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance to the

VOTER ENGAGEMENT DAY WHEREAS
, Both the United States House of Representatives and the United States Senate
passed a proposal to lower the voting age to 18 years on March 23, 1971; and
WHEREAS
, Michigan was the 15th state to ratify
the 26th Amendment; and
WHEREAS
, The 26th Amendment became part of the Constitution on July 1, 1971, three months and
eight days after it was submitted to the states for ratification, making it the quickest amendment ratified; and
WHEREAS
, 18 to 29
year olds make up an estimated 31 percent of the electorate yet on average turnout to vote less than half of the time; and

, young people across the United States and our great state of Michigan are constantly feeling more out of touch with the polit-

Item C-2. Resolution to Amend the Interlocal Agreement that Created the Nankin Transit Commission to Include
the Charter Township of Canton. (CLS)

RESOLUTION OF BOARD OF TRUSTEES CHARTER TOWNSHIP OF CANTON RESO-
LUTION TO AMEND THE INTERLOCAL AGREEMENT THAT CREATED THE NANKIN TRANSIT COMMISSION
TO INCLUDE THE CHARTER TOWNSHIP OF CANTON WHEREAS,
on July 1, 1987 the Nankin Transit Commission
(“NTC” herein) was created by means of an “Interlocal Agency Agreement to Provide a Transit System for the Charter Township
of Canton and the Cities of Garden City, Inkster, Wayne and Westland” (“Agreement” herein) which was approved by the legisla-
tive bodies of each of these communities; and
WHEREAS,
as authorized by the Agreement, on July 31, 1995 the Charter Township
of Canton (“Canton” herein) withdrew from this Agreement by resolution of its Board of Trustees, and the Agreement was amend-
ed to facilitate operations with the remaining four cities; and
WHEREAS,
Canton desires to rejoin NTC; and
WHEREAS,
the
Cities of Garden City, Inkster, Wayne and Westland (“NTC members”) desire to allow Canton to rejoin the NTC, dependent upon
a condition that it will not cost any of these four cities an increase in the annual general fund subsidies that they currently pay to
NTC; and
WHEREAS,
certain amendments should be made to the Agreement, in order to facilitate the addition of Canton to the
NTC and to update the Agreement, and these amendments must be approved by all five of the communities;
NOW, THEREFORE,
in consideration of the mutual covenants, undertakings, understandings and agreements of the parties, and the background facts pre-
sented above, it is hereby resolved that: Each of the NTC members and Canton approve the addition of Canton to the NTC effec-
tive July 1, 2018, subject to the conditions and amendments to the Agreement that are set forth below. Upon approval of this reso-
lution by each of the communities, Canton shall immediately pay to NTC the amount of $45,000, to cover the capital expenses that
will necessarily be expended to make changes in NTC facilities to accommodate the addition of Canton. All sections of the
Agreement which refer to the member communities of the NTC will be amended to include the Charter Township of Canton. Article
III, Section I of the Agreement shall be amended to provide: “Section 1 – Duration This interlocal agreement between the Charter
Township of Canton and the Cities of Garden City, Inkster, Wayne, and Westland shall continue in existence unless terminated in
accordance with Section 2 of this Article.” Article V, Section 3 of the Agreement shall be amended to provide that a quorum for pur-
poses of conducting business shall consist of the presence of at least five (5) board members representing at least three of the par-
ticipating members. Article VI, Section 3 of the Agreement shall be amended to provide: “Section 3 - Improvements No improve-
ment costing more than Fifteen Hundred Dollars ($1500) shall be contracted for or commenced until after an opportunity for com-
petitive bidding or solicitations; the Commission shall have the right to reject any or all proposals.” Article VII, Section 2 of the
Agreement shall be amended to provide: “Funding necessary for the operation of the transit system in excess of the funds provid-
ed by the Commission through SMART (formerly SEMTA) shall be obtained from the participating political unit. In order to ensure
that, as of July 1, 2018, Canton is paying a sufficient amount to the NTC to cover the overhead, manpower and other costs related
to adding Canton to the NTC, and to provide that there will be no additional costs to the other four communities caused by the addi-
tion of Canton, the funding for the operation of the system in excess of: (1) the municipal and community credits provided by the
communities; (2) the fares received from NTC customers; and (3) the funds provided by SMART will be contributed by the partic-
ipating units in the following proportions:

CODE OF ORDINANCES ENTITLED “STORMWATER MANAGEMENT” TO REVISE SECTIONS 106-32, 106-34,
AND 106-70. THE CHARTER TOWNSHIPOF CANTON ORDAINS: SECTION 1. AMENDMENT TO CODE.
Chapter 106
of the Charter Township of Canton Code of Ordinances, entitled “Stormwater Management,” Articles I and II, Section 106-32, 106-
34, and 106-70, are hereby amended to read as follows:
Sec. 106-32. - Findings of fact; purpose.
It is the finding of the township
board that stormwater runoff pollution prevention and the protection of the water quality of the waters of the state is of utmost
importance. The following legislation has been passed by the state and federal legislatures in efforts to protect the environment: The
Natural Resources and Environmental Protection Act (MCL 324.101 et seq.), including: Part 303 thereof (MCL 324.30301 et seq.).
Part 91 thereof (MCL 324.9101 et seq.). Part 301 thereof (MCL 324.30101 et seq.). The United States Water Pollution Control Act,
section 314 (PL 92-55). The United States Clean Water Act, section 404 (PL 95-217). The township has implemented a stormwater
management program. The intent of this program is to manage stormwater flooding and stormwater pollution prevention. As part
of the land use in the township, certain stormwater pollution prevention facilities, drainage systems, retention ponds, detention facil-
ities, and stormwater runoff systems have been constructed in the township. The maintenance and operation of these systems has a
direct impact on flood control, stormwater runoff pollution prevention, and water quality of the waters of the state. (d) The purpose
of this article is to permit, monitor, inspect, and under certain circumstances maintain and repair these flood and pollution preven-
tion control facilities, structures, and systems. * * *
Sec. 106-34. - Fees.
A fee for plan examination, permits, and inspections shall
be established by the township board. * * *

SECTION 2. SEVERABILITY
If any clause, sentence, section, paragraph or part of this Ordinance, or the application of
thereof to any person, firm, corporation, legal entity or circumstances, shall be for any reason adjudged by a court of competent
jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalid the remainder of this Ordinance. It is
hereby declared to the legislative intent of this body that the Ordinance is severable, and that the Ordinance would have been adopt-
ed had such invalid or unconstitutional provisions not have been included in this ordinance.
SECTION 3. REPEAL OF CON-
FLICTING ORDINANCES
All Ordinance or parts of Ordinance in conflict herewith is hereby repealed only to the extent neces-
sary to give this Ordinance full force and effect.
SECTION 4. SAVINGS CLAUSE
All rights and duties which have matured
penalties which have been incurred, proceedings which have begun and prosecution for violations of law occurring before the effec-
tive date of this Ordinance are not affected or abated by this Ordinance.
SECTION 5. PUBLICATION
The Clerk for the Charter
Township of Canton shall cause this Ordinance to be published in the manner required by law.

TO CODE.
Chapter 54 of the Charter Township of Canton Code of Ordinances, Article II, entitled “License” Sections 54-34 and
54-36, are hereby amended to read as follows:
Sec. 54-34. - Exemptions; registration of charitable and nonprofit organizations.
(a) – (d) [Unchanged.] (e) Any person who is authorized by the Department of Leisure Services Director or their designee to par-
ticipate in a township-sponsored event.
* * * Sec. 54-36. - Term and limitation.
(c) A permit issued under this chapter shall not
entitle the applicant to peddle or solicit for commercial purposes at any township or Downtown Development Authority sanctioned
event. Rather, a separate application must be made to the appropriate Township department or the Downtown Development
Authority to be a vendor at any such event. A representative list of events is attached to this ordinance; however, it shall be the
responsibility of the applicant to verify the events and the specific dates on which they will be held each year.

RESOLUTION OF BOARD OF TRUSTEES CHARTER TOWNSHIP OF CANTON, MICHI-
GAN AGREEMENT FOR LONG-TERM MAINTENANCE OF LANDSCAPE FACILITIES FOT THE TOWNS AT
CHERRY HILL CONDOMINIUM WHEREAS,
The Developer (M/I Homes) has applied to the Wayne County Department of
Public Services for approval of streetscape and landscape elements within the Cherry Hill Road right-of-way with respect to the
project known as “The Towns at Cherry Hill Condominium” (the project); and,
WHEREAS,
the developer’s application for
improvements within the right-of-way has been assigned
Wayne County Review Number R-18-269
; and,
WHEREAS,
the
Developer has entered into a Planned Development District agreement with the Charter Township of Canton which includes the
requirement for the developer and future association to provide long-term maintenance of the streetscape and landscape elements
within the right-of-way at the Project; and,
WHEREAS,
the Charter Township of Canton hereby agrees to assume jurisdiction and
accept responsibility for long-term maintenance of the streetscape and landscape improvements at the Project in perpetuity; and,
NOW THEREFORE,
the Charter Township of Canton assumes jurisdiction over and accepts responsibility for long term mainte-
nance of the streetscape and landscape facilities at the Project pursuant to the Wayne County review letter, the Plan, and the right-
of-way construction approval issued by Wayne County; and, To the extent allowed by law, the Charter Township of Canton herby
agrees to indemnify, save harmless, and defend Wayne County, its Department of Public Services, its officials and employees,
against and all claims, suits, and judgements of every name and description arising out of the construction of the propose streetscape
and landscape facilities located within the Cherry Hill Road right-of-way adjacent to the Project. This agreement to indemnify, hold
harmless and defend must not be construed as a waiver of any governmental immunity by Wayne County or the Charter Township
of Canton, including each entity’s elected and appointed officials, and their respective employees, as provided by statute or court
decision.

, that approval has been granted by the Township Board of Trustees of the Charter Township of Canton,
Michigan, authorizing the Township Supervisor to execute, on behalf of the Charter Township of Canton, Michigan, the permits for

Hearing Orders. (MSD)
Motion by Siegrist, supported by Slavens to approve the date of August 14th at 5:30 PM for the purpos-
es of conducting show cause hearings for four properties that failed to comply with the deadlines imposed by the Dangerous
Buildings Hearing Officer in 2018. Motion carried by all members present. Director Faas explained all costs associated with these
properties would go back to the property owners in the form of a lien.

Trustee Graham-Hudak inquired of Director Meier if Public Safety concerns are taken under consideration regarding additional
emergency vehicle runs to the new assisted living complexes the board is approving. Director Meier and Director Faas together
explained this is being taken seriously and they are using this information to project future costs. Supervisor Williams commented
Liberty Fest was a fantastic event and the final figures will be presented to the board at a future meeting. Clerk Siegrist stated next
Tuesday at 10:30 a.m. he will be doing a presentation regarding the voting precinct reallocation done in 2017 and its effect on vot-
ing locations. Voters can go on the township website to verify their polling locations. The Roads Millage information forum will be
held on June 27 th at the Summit on the Park from 4:00 p.m. to 7:00 p.m.

Canton Township Trustee Anne Marie
Graham-Hudak isn't alone in her concerns
about increased senior living facilities
stretching emergency vehicle response too
thin in the community.
“Our run volume is up, particularly
EMS,” Canton Public Safety Director
Joshua Meier said at the June 26 board of
trustees meeting, after Graham-Hudak
inquired about the number of calls.
“We do keep track of that. It does
increase the call volume,”Meier said.
Meier said that issue was studied in
more depth two years ago, and relates to
rules that prohibit the restriction of senior
residences in a township.
Canton Township Supervisor Pat
Williams noted a five-year development
plan, and told Trustee Steven Sneideman
using property tax money can't be the solu-
tion.
“There's going to be more senior citi-
zens,”Williams said. “The nation is aging.”
Williams has asked township legal
staffers several times about approaching
the issue, and he, too, noted zoning law dic-
tates strong limits on keeping facilities out
or limiting locations.
“We cannot. It's illegal,” said Williams.
“There's going to be a significant chal-
lenge,” including staffing to meet emer-
gency vehicle run needs of an older popula-
tion.
At the meeting, municipal officials
agreed the Southeast Michigan Council of
Governments and the Michigan State
Housing Development Authority are good
sources for senior housing data.
Also at the meeting, Canton resident
Mike Schultz expressed concerns about
paying property taxes. Canton Township is
seeking a 1.45-mill yes vote on the August
primary ballot tohelp repair roads.
“And yet we're stuck with it,” Schultz
said of a recent Wayne RESA school tax.
Schultz said he wondered about home val-
ues related to taxes inCanton.
“The DIA (Detroit Institute of Arts)
couldn't make it, the (Detroit) Zoo couldn't
make it,” Schultz said of other recent
regional tax votes. Schultz told the board
members that he heard recently on the
radio of many people who don't have $400
saved.
