A regular meeting of the Board of Trustees of the Charter Township of Canton was held Tuesday, April 22, 2014 at 1150 Canton Center
S., Canton, Michigan. Supervisor LaJoy called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance to the Flag.
Roll Call
Members Present: Anthony, Bennett, LaJoy, McLaughlin, Sneideman, Williams. Members Absent: Yack; Staff Present: Director Bilbrey-
Honsowetz, Director Trumbull, Director Faas, Director Mutchler.
Adoption of Agenda:
Motion by Bennett supported by Williams to
amend the agenda to include minutes from the April 15, 2014 Study Session. Motion carried by all members present.
Approval of
Minutes:
Motion by Bennett, supported by Sneideman to approve the Board Minutes of April 8, 2014. Motion carried by all members
present. Motion by Bennett, supported by Anthony to approve the Board Study Minutes of April 15, 2014. Motion carried by all mem-
bers present.
Citizen’s Non-Agenda Item Comments:
Timothy King, 1573 Molly St. Ypsilanti, MI read a proclamation in support of a
memorial dedicated to the contributions of the Willow Run Bomber Plant Ypsilanti Michigan and the B24 Bomber to our freedom. Mr.
King is seeking signatures of Officials of neighboring communities in support of this effort. George Miller,1946 Briarfield, asked if the
former composting site behind the DPW location has had the debris removed from it. Director Faas stated the site was taken care of as
part of an agreement with Sauk Trail Hills for their clay stockpile. Mr. Miller questioned the criteria for getting a “deer crossing” sign.
Director Faas explained Wayne County does not have a specific criteria, however, Washtenaw County requires 5 deer per lineal mile per
year.
Payment of Bills:
Motion by Bennett, Supported by Williams to approve payment of the bills as presented. Motion carried by all

AN ORDINANCE AMENDING THE CHARTER TOWNSHIP OF CANTON CODE OF ORDINANCES PART I, CHAPTER 74 ENTI-
TLED “UTILITIES”, ARTICLE II, DIVISION 2, SUBDIVISION II ENTITLED “SCHEDULE OF RATES AND CHARGES”, SEC-
TION 74-83. THE AMENDMENTS TO SUB-SECTION (a) PROVIDE FOR REVISED WATER RATES AND CHARGES. THE
AMENDMENTS TO SUB-SECTION (b) PROVIDE FOR REVISED SEWER RATES AND CHARGES.
THE CHARTER TOWNSHIP OF CANTON ORDAINS:
SECTION 1. AMENDMENT TO SUBDIVISION II RATES AND CHARGES.
This Ordinance is hereby adopted to amend Code of Ordinances, Part 1, Chapter 74, Article II, Division 2, Subdivision II,
Rates and Charges to read as follows:
Sec. 74-83. Schedule of rates and charges.
(a)
Water rates and charges.
Water rates and charges shall be as follows:
(1) Consumption rate: $4.54 per 1,000 gallons.
a.
In addition to the consumption charge, there shall be a water cost of service charge per reading cycle, or portion
thereof, based on meter size:

Sewer rates and charges.
Sewer rates and charges shall be as follows:
(1) Sewage treatment rate: $6.13 per 1,000 gallons of the water used or per 1,000 gallons of metered sewage flow.
a.
In addition to the consumption charge, for customers connected to the sanitary sewer system there
shall be a wastewater cost of service charge per reading cycle, or portion thereof, based on meter size:

(2) Minimum sewage bill:
a.
Minimum sewage disposal bill if not connected to the township water system, per quarterly reading cycle: $229.88
plus applicable fixed charges, based on the County minimum volume of 12,500 gallons per month.
b.
Minimum sewage disposal bill if not connected to the township water system, per bi-monthly reading cycle: $153.25
plus applicable fixed charges, based on the County minimum volume of 12,500 gallons per month.
c.
If a customer has a township supplied water meter, installed per Township specifications for their non-township water
source, then readings from that meter shall be used for sewer charges in lieu of the minimum sewage disposal charge.

The following industrial surcharges will be charged when billed to the township by the Detroit
Water and Sewerage Department:
a.
Biochemical oxygen demand (BOD) in excess of 275 mg/l . . . $0.502/lb
b.
Total suspended solids (TSS) in excess of 350 mg/l . . . $0.509/lb
c.
Phosphorus (P) in excess of 12 mg/l . . . $7.508/lb
d.
Fats, oils and grease (FOG) in excess of 100 mg/l . . . $0.483/lb
SECTION 2.
SEVERABILITY
If any clause, sentence, section, paragraph or part of this Ordinance, or application thereof to any person, firm, corporation,
legal entity or circumstances, shall be for any reason adjudged by a Court of competent jurisdiction to be unconstitutional or invalid, said
judgment shall not affect, impair or invalidate the remainder of this Ordinance.
SECTION 3.
REPEAL
All Ordinances, or part of the Ordinances, in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full
force and effect.
SECTION 4.
SAVINGS CLAUSE
All rights and duties which have been mattered, penalties which have been incurred, proceedings which have begun and prosecution for
violations of law occurring before the effective date of this Ordinance are not affected or abated by this Ordinance.
SECTION 5.
PUBLICATION
The Clerk for the Charter Township of Canton shall cause this Ordinance to be published in the manner required by law.
SECTION 6.
EFFECTIVE DATE
The Ordinance becomes effective on the first day of May, 2014 after publication of the second reading.
This Ordinance was duly adopted and/or considered by the Township Board of Trustees of the Charter Township of Canton at its regular
Board meeting called on the twenty-second day of April, 2014 and was ordered given publication in the manner required by law.

Pursuant to Section 27.06 of Appendix A – Zoning, the zoning map is hereby amended by changing the zoning on part of parcel
no. 069-99-0010-700 from R-2, Single-Family Residential to R-3, Single-Family Residential District as shown on the attached zon-

PART II. Severability.
Should any section, subdivision, clause, or phrase of this Ordinance be declared by the courts to be invalid, the validity of the Ordinance
as a whole, or in part, shall not be affected other than the part invalidated.
PART III. Savings Clause.
The amendment of the Canton Code of Ordinances set forth in this Ordinance does not affect or impair any act done, offense committed,
or right accruing, accrued, or acquired, or liability, penalty, forfeiture or punishment, pending or incurred prior to the amendment of the
Canton Code of Ordinances set forth in this Ordinance.

PART IV. Repealer.

PART V. Publication.

Part VI. Effective Date.
A public hearing having been held hereon pursuant to the provisions of Section 103 of Act 110 of the Public Acts of 2006, as amended,
the provisions of this Ordinance shall be published within fifteen (15) days of its adoption of publications of a notice in a newspaper cir-
culated in Canton Township stating the date of enactment and effective date, a brief statement as to its regulatory effect and that a com-
plete copy of the Ordinance is available for public purchase, use and inspection at the office of the Township Clerk during the hours of
8:30 AM to 4:30 PM, Local Time. The provision of this Ordinance shall become effective seven (7) days after its publication.
CERTIFICATION
The foregoing Ordinance was duly adopted by the Township Board of Trustees of the Charter Township of Canton at its regular meeting
called and held on the 22nd day of April, 2013, and was ordered to be given publication in the manner required by law.

Item C-3. Consider Authorization of a Sponsorship Agreement with Community Financial Credit Union.
Motion by Bennett, supported by Williams to authorize the 2014 Sponsorship and Advertising Proposal with Community Financial Credit
Union, 500 S. Harvey, Plymouth, MI 48170 in the amount of $9,990. Motion carried by all members present.
. Item C-4. Consider
Authorization of a Waiver to the Park Ordinance for the Sale and Consumption of Alcohol at Liberty Fest.
Motion by Bennett, sup-
ported by Williams to authorize the sale and consumption of alcohol at the 23rd Annual Liberty Festival on June 12-14, 2014, and fur-
thermore; I move that the following resolution be adopted:
WHEREAS,
the Canton Rotary, through its duly elected officers, make appli-
cation to the MLCC for a Special License for the sale of alcohol for consumption on the premises to be in effect on June 12-14, 2014 dur-
ing Liberty Festival at Heritage Park located at 1010 Canton Center Rd, Canton, Michigan, County of Wayne
. WHEREAS,
the Board of
Trustees is waiving the requirement of Ordinance Section 50-50 for the Liberty Fest Event.
NOW THEREFORE BE IT RESOLVED
that the Charter Township of Canton Board of Trustees approves the Canton Rotary’s sale and consumption of alcohol during the Liberty
Fest, June 12 - 13, 2014. Motion carried by all members present.
GENERAL CALENDAR: Item G-1: First Reading Of An
Ordinance Adding A New Chapter 36 To The Canton Township Code Of Ordinances Entitled “Equal Rights.”
Motion by Bennett,
supported by Sneideman to introduce for first reading an amendment to the Township Code of Ordinances which adds a new Chapter 36,
Equal Rights. Motion carried by all members present. Motion by Bennett, supported by Sneideman to table for consideration a proposed
text amendment to the Township Code of Ordinances and schedule to second reading for May 13, 2014. Motion carried by all members

Item G-2: Municipal Code Corporation Contract For Legal Review Of Ordinances Step One Of Recodification.

Motion by Bennett, supported by Williams to approve the contract with “Municode”, Municipal Code Corporation for the legal
review of the Code of Ordinance for the Charter Township of Canton, Wayne County, Michigan, 48188 in the amount of $8,170.00. I
authorize the Township Clerk to sign the contract. Motion carried by all members present.
Item G-3: Consider Final Approval for
Parkside Estates PDD.
Motion by Bennett, supported by McLaughlin to adopt the following resolution. Motion carried by all members
present.
RESOLUTION OF BOARD OF TRUSTEES CHARTER TOWNSHIP OF CANTON Parkside Estates Final Planned
Development WHEREAS,
the Project Sponsor has requested final approval for a Planned Development for Parkside Estates, locates
north and south of Ford Road west of Ridge Road parcel nos. 070-99-0001-000, 027-99-0005-005, and 027-99-0009-000: and,
WHERE-
AS,
the Planning Commission voted to recommend approval based on the findings that the proposed development plan is consistent with
the goals and objectives of the Comprehensive Plan, subject to the conceptual home plans being referenced and included as a separate
exhibit to the PDD agreement, and subject to a note relative to the future location of the cross access and utility easement being provided
on Exhibit E, provision of enhanced side home elevations including brick and windows, provision of upgrade garage doors on the homes,
and provision of a natural wetland and native area management plan in the association by-law; and,
WHEREAS,
the Board has reviewed
the planned development and determines the proposal to be consistent with the Zoning Ordinance regulations and development objectives
subject to the conditions outlined in the Planning Commission recommendation and recommendations attached hereto and made a part
hereof.
NOW THEREFORE BE IT RESOLVED,
the Board of Trustees of the Charter Township of Canton, Michigan does hereby
approve the Final PDD for Parkside Estates, subject to the terms set out in the proposed agreement and development plan and, further sub-
ject to the conceptual home plans being referenced and included as a separate exhibit to the PDD agreement, a note relative to the future
location of the cross access and utility easement being provided on Exhibit E, provision of enhanced side home elevations including brick
and windows, provision of upgrade garage doors on the homes, and provision of a natural wetland and native area management plan in

CHARTER TOWNSHIP OF CANTON Parkside Estates North Preliminary Plan WHEREAS,
the Project Sponsor has requested
preliminary site plan approval for Parkside Estates Site Condominiums identified as EDP# 027-99-0005-005 and 027-99-0009-000; and
WHEREAS,
the Planning Commission voted to recommend approval based on the findings that the proposed development plan is con-
sistent with the goals and objectives of the Comprehensive Plan; and,
WHEREAS,
the Board has reviewed the proposed development
and determines the proposal to be consistent with the Zoning Ordinance regulations and development objectives subject to the conditions
described in the analysis and recommendations attached hereto and made a part hereof.
NOW THEREFORE BE IT RESOLVED,
the
Board of Trustees of the Charter Township of Canton, Michigan does hereby approve the requested Preliminary Plan for Parkside Estates
North.
Item G-5: Consider Six Month Extension to the Approval of the Tentative Preliminary Plat for Sheldon Estates Subdivision.
Motion by Bennett, supported by McLaughlin to grant approval of a six month extension for the approval of the tentative preliminary plat
for Sheldon Estates to be located on Sheldon Road between Palmer and Cherry Hill Roads (tax EDP No.085-99-0005-701.). Motion car-
ried by all members present.
Item G-6: Consider the First Reading of an Amendment to Appendix A-Zoning of the Code of
Ordinances for the Skelton Rezoning.
Motion by Bennett, supported by McLaughlin to introduce and hold the first reading of the pro-
posed amendment to the zoning map found in Appendix A of the Code of Ordinances for the Skelton Rezoning as provided in the attached
ordinance and map. Motion carried by all members present. Motion by Bennett, supported by McLaughlin to table consideration of the
amendment for a second reading on May13, 2014. Motion carried by all members present. A complete copy of the ordinance changes can

RESOLUTION OF BOARD OF TRUSTEES CHARTER TOWNSHIP OF CANTON
Uptown Planned Development Amendment and Extension WHEREAS,
the Project Sponsor has requested approval for an amendment
and extension to the Uptown Planned Development located north of Cherry Hill Road between Ridge Road and just east of Denton Road
on tax parcel nos. 067 99 0011 704, 067 99 0011 705, 067 99 0011 706, 072 99 0003 705, 072 99 0003 708, 072 99 0003 707, 072 99
0003 709, 072 99 0003 710, 072 99 0015 701, 072 99 0015 702, 072 99 0015 703, 072 99 0015 704, 072 99 0017 701, 072 99 0019 704
and 072 01 0001 000 through 072 01 0018 000 ; and,
WHEREAS,
the Planning Commission voted 6-0 to recommend approval based on
the findings that the proposed development plan is in keeping with the intent of the original Uptown development plan and that the pro-
posal is consistent with the goals and objectives of the Comprehensive Plan for the Cherry Hill Village Development Area; and,
WHERE-
AS,
the Board has reviewed the amendment to the Uptown Planned Development and determines the proposal to be consistent with the
Zoning Ordinance regulations and development objectives subject to the conditions described in the analysis and recommendations
attached hereto and made a part hereof.
NOW THEREFORE BE IT RESOLVED,
the Board of Trustees of the Charter Township of
Canton, Michigan does hereby approve Amendment No 4 to the Uptown Planned Development Agreement, including the request to extend
the expiration date from November 27, 2014 to November 24, 2020 subject to the terms set out in the proposed agreement and develop-
ment plan.
Item G-8: Consider Award of a Contract to DanJo Construction L.L.C. for 2014 Heritage Park ADA Improvements

Motion by Bennett, supported by McLaughlin to award a contract for the 2014 Heritage Park ADA Improvements for a not-to-exceed
amount of $147,901.44 to DanJo Construction L.L.C. and authorize the Clerk to sign the contract documents. Motion carried by all mem-
bers present. Motion by Bennett, supported by Williams to approve the following budget amendment to the Community Development
Block Grant Fund: Increase Expense 274-666.849 ADA Improvements $148,000 Increase Revenue 274-000.501 Federal Grants $148,000.
Motion carried by all members present.
Item G-9: Consider Approval of Annual Maintenance and Technical Support for Cityworks
Asset Management Software.
Motion by Bennett, supported by Sneideman to approve the Annual Software Maintenance and Technical
Support Agreement for Cityworks from Azteca Systems, Inc., 11075 South State St., Suite 24, and Sandy, UT 84070 and approve a pur-
chase order for a not-to-exceed amount of $40,000. Motion carried by all members present.
Item G-10: Consider Authorization of
Agreement with TLQ Sound Service to Provide Audio and Lighting Needs for the 2014 Liberty Festival.
Motion by Bennett, sup-
ported by Sneideman to authorize the agreement with TLQ Sound Service, 15530 Winston, Redford MI 48239 in the amount of $5,250
for sound and lighting for the 2014 Liberty Festival. Motion carried by all members present.
Item G-11: Consider Authorization of
Purchase of Lights for Preservation Park.
Motion by Bennett, supported by Williams to approve the purchase of light fixtures and poles
from Michigan Lighting Systems East, 1389 Wheaton Ave., Suite 500, Troy, MI 48083 in the amount of $9,400.00 from Account 101-
270-50.970_0080. Motion carried by all members present. Motion by Bennett, supported by McLaughlin to award the installation of lights
to Van Buren Electric, 141 N. Mill, Plymouth, MI 48170 in the amount of $6,870.00 to be taken from Account # 101-803-801_0050.

Item G-12: ConsiderApproval of One-Year Service Agreement for Motorola Laptops.
Motion
by Bennett, supported by McLaughlin to approve a Motorola laptop one-year service agreement with Motorola Solutions, Chicago
Illinois, in the amount of $7,642.80, utilizing funds budgeted in the 2014 Police Professional and Contracted Services Account #207-301-
50.801.0050. Motion carried by all members present.
Item G-13: Consider Approving Byrne Justice Assistance Grant to Purchase 14
Pull Stations for Lockdown Notification System in Plymouth-Canton Community Schools.
Motion by Bennett, supported by
Sneideman to approve the acceptance of the Byrne Justice Assistance Grant (JAG) for the purchase of 14 Lockdown Notification Pull
Stations to be installed in Canton’s 14 Plymouth-Canton Community School building. Also, to approve the purchase of 14 pull stations in
the amount of $27,930, from Camtronics Communication Company, with $20,000 being reimbursed by the Byrne JAG, and $7,903 reim-
bursement by Plymouth-Canton Community Schools. Motion carried by all members present. Motion by Bennett, supported by Williams
to approve the following budget amendment to the 2014 Police Budget:
Increase Revenues:
Police Federal Grants: #207-000.501 $20,000
Police Contributions: #207-000.674 $ 7,930
Increase Appropriations:
Police Program Expense- Byrne JAG: #207-301-50.743.0019

Item G-14: Adoption Of A
Resolution For Approval Of Application For Additional Credited Service By Robert Smedley.
Motion by Bennett, supported by
McLaughlin to adopt the Resolution allowing the purchase of additional credited service by Robert Smedley. Motion carried by all mem-
bers present.
Item G-15: Adoption Of A Resolution For Approval Of Application For Additional Credited Service By Phil LaJoy.
Motion by Bennett, supported by Williams to allow Supervisor LaJoy to recuse himself from Item G-15. Motion carried by all members
present. Motion by Bennett, supported by Williams to adopt the Resolution allowing the purchase of additional credited service by Phil
LaJoy. Motion carried by all members present.
