AN ORDINANCE OF THE
CHARTER TOWNSHIP OF CANTON CODE OF ORDINANCES; AMENDING CHAPTER 86, PART I, CHAPTER 86 FLOODS,
ARTICLE II – FLOOD DAMAGE PREVENTION, SECTION 86-38 “BASIS FOR ESTABLISHING AREAS OF SPECIAL FLOOD
HAZARD”; PROVIDING FOR DEFINITION, SEVERABILITY, PUBLICATION AND EFFECTIVE DATE.
THE CHARTER
TOWNSHIP OF CANTON ORDAINS: SECTION 1. AMENDMENT TO THE CODE
Chapter 86-38 Floods is hereby amended to
read as follows:
Section 86-38 – Basis for establishing areas of special flood hazard.
(a) The purpose of this chapter is to designate
an enforcing agency to discharge the responsibility of the Charter Township of Canton located in Wayne County, and to designate reg-
ulated flood hazard areas under the provisions of the State Construction Code Act, Act No. 230 of the Public Acts of 1972, as amended.
(b) Pursuant to the provisions of the state construction code, in accordance with Section 8b (6) of Act 230, of the Public Acts of 1972,
as amended, the Building Official of the Charter Township of Canton, is hereby designated as the enforcing agency to discharge the
responsibility of the Charter Township of Canton, under Act 230, of the Public Acts of 1972, as amended, State of Michigan. The Charter
Township of Canton assumes responsibility for the administration and enforcement of said Act throughout the corporate limits of the
community adopting this ordinance. (c) Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of
Act 230, of the Public Acts of 1972, as amended, Appendix G of the Michigan Building Code shall be enforced by the enforcing agency
within the Charter Township of Canton. (d) The Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS) entitled
“Wayne County, Michigan (All Jurisdictions)” and dated 2/2/2012 and the Flood Insurance Rate Map(s) (FIRMS) panel number(s) of
26163C; 0185E, 0195E, 0201E, 0202E, 0203E, 0204E, 0208E, 0210E, 0212E, 0215E, 0216E, and 0218E dated 2/12/2012 are adopted
by reference for the purposes of administration of the Michigan Construction Code, and declared to be a part of Section 1612.3 of the
Michigan Building Code, and to provide the content of the “Flood Hazards” section of Table R301.2(1) of the Michigan Residential
Code. (e) Flood hazard areas additional to those areas described in the flood insurance study may exist in the township. The location of
these areas shall be designated by the Building Official upon determination by the Township Engineer utilizing the best available flood-
plain data.
SECTION 2. SEVERABILITY
If any clause, sentence, section, paragraph or part of this Ordinance, or application thereof
to any person, firm, corporation, legal entity or circumstances, shall be for any reason adjudged by a court of competent jurisdiction to
be unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of this Ordinance.
SECTION 3.
REPEAL
All Ordinance or parts of Ordinances in conflict herewith are hereby repealed only to the extent necessary to give this
Ordinance full force and effect.
SECTION 4. SAVINGS CLAUSE
All rights and duties which have mattered, penalties which have
been incurred, proceedings which have begun and prosecution for violations of law occurring before the effective date of this Ordinance
are not affected or abated by this Ordinance.
SECTION 5. PUBLICATION
The Clerk for the Charter Township of Canton shall cause
this Ordinance to be published in the manner required by law.
SECTION 6. EFFECTIVE DATE
This Ordinance shall take full force

TRIBUTIONS AND CO-PAYS FROM THE PREVIOUS IN-HOUSE COUNSEL TO THE NEW IN-HOUSE COUNSEL.

Motion by Bennett, supported by McLaughlin, that the contract to preserve medical benefit and copay contributions
between Canton Township and Audrey Robinson be assigned to Kristin Kolb. Motion carried unanimously.
Item 3. APPOINT
KRISTIN KOLB TO REPRESENT CANTON IN PRE-TRIAL AND SETTLEMENT CONFERENCES. (SUPERVISOR)
Motion by Bennett, supported by McLaughlin to appoint Kristin Kolb as Canton’s Representative in Pre-Trial and Settlement
Conferences. Motion carried unanimously.

by Bennett, supported by McLaughlin, to appoint Kristin Kolb as the Canton Township Member Representative to the Michigan

Item 5. SET PUBLIC HEARING DATE FOR
MAYSER USA, FOR INDUSTRIAL FACILITIES EXEMPTION CERTIFICATE AND EXEMPTION OF PERSONAL PROP-
ERTY CERTIFICATE. (SUPERVISOR)
Motion by Bennett, supported by McLaughlin to set the public hearing for February 14,
2012, to consider the Industrial Facilities Exemption and Personal Property Exemption applications for Mayser USA, for real and per-
sonal property at their facility located at 4812 DeWitt. Motion carried unanimously.
Item 6. APPROVAL OF MCACA GRANT
FUNDS. (CLS)
Motion by Bennett, supported by McLaughlin to authorize the acceptance of a grant for $6,000 from the Michigan
Council for Arts and Cultural Affairs, Michigan Economic Development Corporation, 300 North Washington Square, Lansing, MI
48913, towards the programming expenses for the fiscal year 2012 African American History Through Artist Eyes program, and further
authorize a $6,000 match be made (contracted services budget account #101-760-55.801_0050). Motion carried unanimously. I

ACCEPT PASS GRANT FROM WAYNE COUNTY. (CLS)
Motion by Bennett, supported by McLaughlin to accept PASS grant
funds from Wayne County Children and Family Services - Prevention Services Division, 640 Temple, 5th Floor, Detroit, MI 48201 in
the amount of $15,000. Further, I move to authorize increase to revenue account #101-691-62.539 by $15,000 and increase to expense
account #101-691-62.742 by $15,000. Motion carried unanimously.
Item 8. APPROVAL OF 2011-2012 SPECIALIZED SERVICES
OPERATING ASSISTANCE PROGRAM. (CLS)
Motion by Bennett, supported by McLaughlin to approve the 2011-2012
Specialized Services Operating Assistance Program contract with SMART in the amount of $31,942 (Social Services-Transportation
Account #101-670.860) and to authorize the Township Supervisor to sign the contract. Motion carried unanimously.
Item 9. AUTHO-
RIZE THE YOUTH SPORTS AGREEMENTS. (CLS)
Motion by Bennett, supported by McLaughlin to authorize Youth Sports
Agreements with the Canton Victory Hockey Association, the Greater Canton Youth Baseball and Softball Association, Canton Lions
Football Club, and Canton Soccer Club with each agreement being valid January 1, 2012 thru December 31, 2012. Motion carried unan-
imously.
Item 10. APPROVE REQUIRED FIRE LANE SIGNS TO BE RE-INSTALLED IN GLENGARRY SUBDIVISION.

Motion by Bennett, supported by McLaughlin to approve the re-installation of fire lane signs required during the original site plan
process of Glengarry subdivision. This includes both sides of Glengarry Boulevard, and the fire hydrant side of all other streets and
courts in the subdivision. Motion carried unanimously.

Motion by Bennett, supported by Taj to authorize the Township attorney to pursue settlement negotiations
as recommended in the Wheeler vs. Canton case. Motion carried unanimously.

Canton Farmers Market to have winter hours
While most of us have been
snuggled up indoors well away
from the cold, Canton Farmers
Market organizers have been
planning three special Winter
Markets.
The first winter market is
planned from 10 a.m. until 2 p.m.
Feb. 12 at the Cady-Boyer Barn,
located at Preservation Park at
500 N. Ridge Road. Additional
Winter Markets will take place
March 18 and April 22 inside the
pre-Civil War era barn, which
dates back to the late 1800s.
Eighteen seasonal Canton
Farmers Market vendors will be
onhand selling their local goods.
Locally grown and made prod-
ucts available at the market will
include: spinach, carrots, radish-
es, honey, jams & jellies, farm
eggs, artisan cheese & bread,
apples, cider, frozen blueberries,
flavored butters, soup starters,
organic-grass fed-antibiotic free
meats, home made sauerkraut,
dried peppers, sauces, marinades,
mustards, dressings, baked goods,
smoked fish, a variety of hand cut
jerky &meat sticks, jarred pickles
and more. In addition, you will
also find: hand crafted soaps, dog
treats and soap and soy candles.
"We are thrilled this season to
have hoop house produce at our
Winter Markets," said Canton
Farmers Market Manager Tina
Lloyd. "Both Hand Sown Farm
and Prochaska Farms are growing
spinach in their hoop houses,
which are a type of green house
that uses solar energy to heat the
ground during winter months.
These farmers are able to bring a
little bit of fresh produce to our
Winter Markets which is a plus for
Market-goers."
Visitors to these three Winter
Farmers Markets are encouraged
to take part in a pasta collection to
help fill the shelves of the Open
Door Ministry, a Canton-based
non-profit organization. First
GradeDaisy Troop 40726will help
coordinate this pasta collection, as
well as have boxes of pasta avail-
able for $1 for those who would
like to donate.
During the regular season, the
Canton Farmers Market offers
seasonal produce, including fresh
vegetables, fruits, flowers and spe-
cialty products from area vendors.
The market will again be open
every Sunday, rain or shine, May
13 through Oct. 14 in Preservation
Park but with new hours from 9
a.m. to 1 p.m. For more informa-

Wanted
The Canton Police Department is asking for
assistance with identifying the suspect in the
robbery of the Credit Union Service Center at
about 5:45 p.m. Jan. 18. Witnesses told police
the man entered the Sheldon Road building,
handed the teller a note, implied that he had a
weapon, and exited with an undisclosed
amount of cash. The black male suspect is
described as 5-feet, 8-inches tall, weighing
about 180 pounds with a medium build, goat-
ee and mustache. He was wearing a black
hoodie jacket with the Nike logo; his hood was
up, with dark glasses, black gloves, blue
undershirt and blue jeans, at the time of the
robbery. Police are asking anyone with infor-
mation on the identity of the suspect to contact
the Canton Police Department at (734) 394-
5400. Crime Stoppers will also take anony-
mous tips at 1-800-SPEAK UP, or online at
www.1800speakup.org. Crime Stoppers will
pay up to $1,000 for a tip that leads to an
arrest.

'The Front 40' would be located near the
entrance, and feature a pond, sledding hill
and trails, along with other amenities, such
as a botanical gardens. 'The Community
Center' would house any community build-
ings, including the indoor/outdoor pool-
which could include a lazy river feature.
'The Hundred Acre Wood,' would be located
along the eastern edge of the property,
which is the most highly forested, and be
primarily rustic nature trails and perhaps a
wooden pavilion. 'The Great Lawn' would be
along the south, and be a place for commu-
nity gatherings; it would house a amphithe-
ater or bandshell, too.
The plan also incorporated a 'Mountain
Bike Park,' which would include additional
trails, alongwith a facilitywhere bikes could
be rented.
'The Energy Park,' located along the
northwestern edge where the oil and gas
wells already exist, proved to be the most
controversial. It would house wind turbines
that would power the entire site and also
serve as an educational site about uses of
green energy. Trustees Christopher Roosen
and Marv Gans both tried to have different
portions of that stricken from the concept
plan, but both motions failed for lack of sup-
port.
All in all, trails were among themost pop-
ular potential uses for the land; they
appeared high on virtually every list devel-
oped by the various focus groups that took
part in the public input phase. There would
be about 5 miles of trails all in all, according
toPlunkard.
“This is just a guide, it's not a prescription
for development for the next 20 years,” he
said. “It's amenu of choices.”
Reaction from the packed room of resi-
dents was generally favorable, although
some were concerned about the traffic flow,
cost of the project, and the cost to maintain
it. Some wanted to ensure as much land be
preserved as possible.
“I like the general layout of the plan; how
it's going to be funded-that's the question,”
saidTomStraub.
Abbo said the clean up of the property
would be funded through a Brownfield
Redevelopment Authority, which uses the
increases in taxable value to provide funds
for remediation. The buildings would come
down as soon as possible, he said. He said
he'd also entertain selling off portions of the
property, if the board and community were
in consensuswith that.
“There are valuable pieces of property
along SevenMileRoad,” Abbo said.
The first definitive use was announced
recently. A portion of the property will
house a medical facility developed by the
University of Michigan Hospital system. A
site plan for the commercial component-the
Haggerty and SevenMileRoad corner-could
be submitted this year, too.
